การจดเครื่องหมายการค้าด้วยตนเองระบบออนไลน์ นั้นทำได้ไม่ยากเนื่องจากเว็บไซต์ของกรมทรัพย์สินทางปัญญาพยายามจะสร้างระบบให้สะดวกใช้งานและช่วยเหลือประชาชน และ รองรับนวัตกรรมแบบเอไอ แต่การเตรียมเอกสารและการลงทะเบียนยังมีขั้นตอนที่เกี่ยวข้องกับกฎหมายซึ่งยากในการทำความเข้าใจ ดังนั้นบทความนี้ได้นำเสนอ 6 หลักเกณฑ์สำคัญง่ายๆ สำหรับการจดเครื่องหมายการค้าด้วยตนเองระบบออนไลน์ ดังนี้
1.ขั้นตอนการเตรียมข้อมูล
1.1 เตรียมชื่อและภาพเครื่องหมายการค้า ในรูป jpeg เพื่อรองรองรับการ upload ในระบบการยื่นจดทะเบียนเครื่องหมายการค้า
1.2 เลือกจำพวกและรายการสินค้าที่ต้องการคุ้มครอง เช่น จำพวก 43 ร้านอาหารและเครื่องดื่มจากลิ้ง

2.ขั้นตอนการสืบค้นเครื่องหมายการค้าฟรี
2.1 ตรวจสอบความเหมือนคล้ายว่าเครื่องหมายการค้าของเราสามารถยื่นจดทะเบียนได้หรือไม่ ตามลิ้งด้านล่าง

3.ขั้นตอนการเตรียมเอกสาร
3.1 จดในนามบุคคลไทย คนเดียว หรือ หลายคนรวมกัน ใช้สำเนาบัตรประจำตัวประชาชน
3.2 จดในนามบุคคลต่างชาติ คนเดียว หรือ หลายคนรวมกัน ใช้สำเนาหนังสือเดินทางหน้ารูป และ หน้าขาเข้าไทย คือหน้าที่ตราขาเข้าเพื่อแสดงว่าบุุคคลนี้มีตัวตนจริง

3.3 จดในนามบริษัทไทย บริษัทเดียว หรือ หลายบริษัทร่วมกัน ใช้สำเนาหนังสือมอบอำนาจและหนังสือรับรองนิติบุคคลไม่เกิน 6 เดือน
3.4 จดในนามบริษัทต่างประเทศ บริษัทเดียว หรือ หลายบริษัทร่วมกัน ใช้สำเนาหนังสือมอบอำนาจ และหนังสือรับรองนิติบุคคล สำเนาหนังสือเดินทางบุคคลผู้มีอำนาจลงนาม ** หนังสือมอบอำนาจ ต้องทำโนตารี มาจากต่างประเทศ เพื่อแสดงว่าบริษัทนี้นี้มีตัวตนจริง

To apply for the registration or renewal of our trademarks and/or service marks and/or collective marks; to accept the assignment of trademarks and/or service marks and/or collective marks to us, or to assign any of our trademarks and/or service marks and/or collective marks to others; to register any change of name in reference to our trademarks and/or service marks and/or collective marks; to file notices of opposition; to withdraw applications; to apply for the cancellation of any trademarks and/or service marks and/or collective marks similar to or conflicting with any of our trademarks and/or service marks and/or collective marks; to enter into consent and compromise; to amend the specification of goods; and to prosecute and defend our trademarks and/or service marks and/or collective marks before the Board of Trademarks.
To defend our trademarks and/or service marks and/or collective marks from infringement, imitation, opposition or attack whether by way of civil court or criminal proceedings or otherwise and to file criminal charges or complaints with the Police Authorities and/or Administrative Officials and to file, prosecute, defend and carry to completion in the Courts and administrative tribunals of Thailand, all our claims or legal proceedings, both civil and criminal, including bankruptcy against any natural or juristic persons, and enforce any judgements or orders obtained therein, including defending any counterclaims or separate suits or claims, to compromise, refer to arbitration or settle any such proceedings or take such other steps as may be necessary in the premises, including the power to receive money or other property due or to become due in the premises from any court, administrative tribunal, person or persons or from any juristic entity.
For the aforesaid purposes, in our name to sign and lodge all papers and writings which they or any of them in their aforesaid capacity may deem necessary or desirable; to alter and amend documents relating to our trademarks and/or service marks and/or collective marks; to attend and appear on our behalf at Thailand government offices or elsewhere, or before any court or judicial officer in Thailand; to appoint a substitute or substitutes under him or them for the performance of any or all of the aforesaid acts, and the same at pleasure to remove, including previous attorney or attorneys and generally to do all such acts, deeds and things as they or any of them may in their discretion think fit for the carrying out of these presents.
We hereby certify that we are the owner of the marks or otherwise legally entitled to file applications for registration of the marks.

3.5 จดในนามมูลนิธิ หรือ หน่วยงานราชการ ใช้สำเนาหนังสือมอบอำนาจ สำเนาพรบ.จัดตั้ง สำเนาหนังสือแต่งตั้งผู้ลงนาม และ สำเนาบัตรประชาชนผู้รับแต่งตั้ง
4.หลักเกณฑ์เรื่องภาพเครื่องหมายการค้า
4.1 เครื่องหมายการค้าหลายภาษา เช่น 2-3 ภาษาไทย+จีน+อังกฤษ ต้องมี 1 ภาษาที่มีขนาดใหญ่ที่สุด หากมีขนาดเท่ากัน นายทะเบียนอาจจะสั่งให้แยกคำขอเพราะเสมือนยื่นจดทะเบียนหลายเครื่องหมายในคำขอเดียวกัน

4.2 เครื่องหมายการค้า รูปร่างหรือรูปทรงของวัตถุ สามารถยื่นจดทะเบียนได้

4.4 เครื่องหมายการค้าที่เป็น ลายมือชื่อ สามารถยื่นจดทะเบียนได้ แต่ต้องมีหนังสือชี้แจงว่าเป็นของใครและมีหนังสือให้ความยินยอมจากเจ้าของลายมือชื่อ
4.5 เครื่องหมายการค้าที่เป็น ภาพบุคคล สามารถยื่นจดทะเบียนได้ แต่ต้องมีหนังสือชี้แจงว่าเป็นของใครและมีหนังสือให้ความยินยอมจากเจ้าของภาพ หากบุคคลนั้นเสียชีวิตแล้วใช้เอกสารยินยอมจากทายาทหรือผู้จัดการมรดก

5.หลักเกณฑ์เรื่องเครื่องหมายรับรอง
เครื่องหมายรับรองอาหารไทย เครื่องหมายรับรองการตรวจคุณภาพสินค้า ต้องแสดงข้อบังคับ และ หลักเกณฑ์การดำเนินการรับรอง
6.คำขอถือสิทธิย้อนหลังเครื่องหมายการค้า
เช่น ยื่นจดทะเบียนในประเทศจีนเมื่อวันที่ 1/1/2000
และ นำคำขอดังกล่าวมายื่นจดทะเบียนในประเทศไทย ภายใน 6 เดือน เช่นนำมายื่นเมื่อ 1/5/2000
สามารถขอใช้สิทธิย้อนหลังตามมาตรา 28 หรือ 28 ทวิ โดยขอเอกสาร claim priority มาจากประเทศจีน เพื่อขอให้วันยื่นจดทะเบียนในประเทศไทยคุ้มครองย้อนหลังไป เมื่อวันที่ 1/1/2000 ป้องกันการที่บุคคลอื่นนำมายื่นก่อนโดยไม่สุจริต
การจดเครื่องหมายการค้าสามารถจ้างได้หรือไม่
